MotoTracker, LLC is an Arizona limited liability company operating the MotoTracker motorcycle ride management platform ("Service"). Contact us at contact@mototracker.app.

2. Information We Collect

Account Information

• Name and email address provided during registration
• Password (stored as a one-way bcrypt hash; we cannot recover your password)
• Username and public profile information you choose to provide
• Date and version of your agreement to these Terms & Privacy Policy

GPS & Location Data

• Real-time GPS coordinates transmitted from your device during GPS-tracked rides
• Geofence entry events (when your device enters a waypoint area)
• GPX track files you upload as evidence
• Photo EXIF data (including geolocation, if present) from evidence submissions

Ride Activity

• Rides you join and your participation status
• Evidence submissions (photos, GPX files, GPS verifications)
• Waypoint hits and verification results

Technical Data

• Log data (IP addresses, browser type, pages visited) for security and diagnostics
• Device identifiers (IMEI / Traccar unique ID) for GPS tracking devices linked to your account

3. How We Use Your Information

• Service delivery: Processing ride participation, waypoint verification, and GPS tracking
• Account management: Authentication, password recovery, and account security
• Communication: Service notices, security alerts, and support responses
• Safety & integrity: Detecting fraud, abuse, or evidence manipulation
• Legal compliance: Fulfilling legal obligations under applicable law

We do not sell your personal data to third parties.

4. GPS Tracking & Third-Party Services

GPS location data is transmitted to and processed by Traccar, an open-source GPS tracking server operated by us. This data is used solely for waypoint geofence verification within the Service. Your location is visible to ride coordinators and administrators during active GPS-tracked rides.

We do not share your real-time location with any third party beyond the Traccar instance we operate.

5. Data Sharing

We do not sell, rent, or share your personal information with third parties except:

• Ride coordinators and administrators (limited to ride-related data for rides you participate in)
• Service providers assisting us in operating the platform (e.g., hosting), bound by confidentiality obligations
• When required by law, court order, or governmental authority
• In connection with a merger, acquisition, or sale of all or substantially all of our assets

6. Data Retention

We retain your account data for as long as your account is active. GPS track data and evidence submissions are retained for the duration of the associated ride and a reasonable period thereafter for dispute resolution. You may request deletion of your account and associated data by contacting us.

7. Your Rights

Depending on your jurisdiction, you may have rights including:

• Access: Request a copy of personal data we hold about you
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your account and data
• Portability: Request your data in a portable format (GDPR / CCPA)
• Opt-out of GPS tracking: Disable the Traccar client app on your device at any time

8. International Users

MotoTracker is operated from Arizona, USA. If you access the Service from outside the United States, your information may be transferred to and processed in the United States. We take reasonable steps to ensure appropriate data protection safeguards are in place.

GDPR (European Union): If you are in the EU/EEA, you have additional rights under the General Data Protection Regulation. Our lawful basis for processing is your consent (given at registration) and the performance of our contract with you.

CCPA (California): California residents may request disclosure of personal information we have collected and have the right to opt out of the sale of personal information. We do not sell personal information.

Philippines Data Privacy Act: Users in the Philippines have rights under Republic Act No. 10173 including access, correction, and erasure of personal data.

9. Cookies & Tracking

We use session cookies for authentication and to maintain your login state. We do not use third-party advertising trackers. No cross-site tracking cookies are used.

10. Children's Privacy

The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If we become aware that a minor has registered, we will delete that account.

11. Security

We implement industry-standard security measures including encrypted data transmission (HTTPS/TLS), hashed password storage, and access controls. No system is completely secure; you use the Service at your own risk.

12. Changes to This Policy

We may update this Privacy Policy periodically. We will notify users of material changes by updating the version date. Continued use of the Service constitutes acceptance of the updated policy.
