1. Acceptance of Terms

By registering for or using MotoTracker ("the Service", "we", "us", "our"), operated by MotoTracker, LLC, an Arizona limited liability company, you ("User", "you") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

You must be at least 18 years of age to create an account or use the Service.

2. Description of Service

MotoTracker is a motorcycle ride management and GPS tracking platform that enables ride coordinators to create rally and explorer rides, manage waypoints and verification rules, and allows riders to participate, submit evidence, and track their positions during active rides.

The Service includes:

• Ride creation, management, and participation tools
• GPS location tracking via integration with Traccar, a third-party GPS server
• Evidence submission (photos, GPX files, GPS tracks)
• Waypoint verification and scoring

3. GPS Tracking & Location Data

By enabling GPS tracking and participating in a GPS-tracked ride, you expressly consent to the real-time collection, processing, and storage of your geographic location data.

• GPS tracking is only active during rides you have joined and for which tracking is enabled.
• Location data is transmitted to our Traccar GPS server for geofence-based verification.
• Ride coordinators and administrators may view your position during active rides.
• You may disable GPS tracking on your device at any time; doing so may affect your ability to receive automatic waypoint verifications.

4. Motorcycle Safety Disclaimer

MotoTracker does not promote unsafe riding behavior. You are solely responsible for your safety and the safety of others while operating a motorcycle or any vehicle. By using the Service, you acknowledge:

• Never interact with the MotoTracker app while riding. Pull over safely before using your phone.
• GPS tracking and waypoint challenges are designed to be completed during lawful stops or naturally occurring route navigation — not as an incentive to speed or violate traffic laws.
• MotoTracker, LLC is not responsible for any accidents, injuries, property damage, or legal consequences arising from your participation in any ride or use of this Service.
• You assume all risk associated with motorcycle riding and participation in rally or explorer rides.

5. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• One account per person. You may not share accounts.
• We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Content

When you submit photos, GPX files, or other evidence ("User Content"), you grant MotoTracker, LLC a non-exclusive, royalty-free license to store and display that content in connection with the Service. You represent that you own or have the rights to any content you submit.

7. Prohibited Conduct

You agree not to:

• Falsify, spoof, or manipulate GPS data, photos, or any verification evidence
• Use the Service to engage in any unlawful activity
• Attempt to gain unauthorized access to other accounts or the system
• Interfere with the operation of the Service
• Use the Service while operating a vehicle

8. Limitation of Liability

To the maximum extent permitted by applicable law, MotoTracker, LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of data, or loss of revenue, arising out of or related to your use of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

9. Indemnification

You agree to indemnify and hold harmless MotoTracker, LLC and its members from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account by contacting us at contact@mototracker.app.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the version date and, where appropriate, requesting re-acknowledgement at login. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, United States of America, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Arizona, and you consent to personal jurisdiction in Arizona.
